Hon’ble Delhi High Court while dealing with a petition here on 27-03-2019 in the case of “MOHAN SINGH v. STATE (GOVT OF NCT DELHI)” stated that bail shall be granted if the petitioner has already suffered long incarceration.
BRIEF FACTS OF THE CASE
One complainant has been filed that on the day of the incident at about 7:15 pm when the complainant was going to the factory of his uncle, four persons came in front and started fighting with him.
They were alleged to have attempted to snatch his mobile phone and one of them i.e., the petitioner was alleged to have picked up a piece of brick and attacked him, on account of which he sustained a fracture above his right eye.
The petitioner was in incarnation for 87 days. Thus, this petition was filed seeking regular bail in FIR No.981/2018 under Sections 394/511/34 IPC, Police Station Samaipur Badli.
DECISION OF THE COURT
Hon’ble Court held that bail shall be granted if the petitioner has already suffered long incarceration.
Here, in this case the petitioner had already suffered incarceration for nearly 87 days, leading to the grant of the bail.
