Hon’ble Allahabad High Court while dealing with the petition here on 07-03-2019 in the case of “Jaidev Madan v. Satish Ramse” stated that the revisional court shall consider imposing condition for payment of decreetal amount while extending the interim protection so that the equity stands balanced.
BRIEF FACTS OF THE CASE
The petition was filed against the order dated 29.1.2019 by which the revisional court, while granting stay in favour of the revisionist against his eviction in pursuance of the decree under challenge in revision, has fixed a date for final hearing of the revision itself.
It was alleged by the petitioner that the revisional court has granted stay to the tenant without imposing any condition regarding payment of decreetal amount.
DECISION OF THE COURT
Hon’ble Court held that in case the revision could not be heard finally on the next date for any reason, the revisional court shall consider imposing condition for payment of decreetal amount while extending the interim protection so that the equity stands balanced.
