Hon’ble Allahabad High Court while dealing with the petition here on 28-02-2019 in the case of “Roshan Khan @ Osama v. State Of U.P. And Another” directed that juvenile Justice Board to consider the law that the board shall release the accused after taking personal bond, during the pendency of inquiry of the juvenility of accused.

BRIEF FACTS OF THE CASE

This application was filed seeking direction to the Principal Judge, Juvenile Justice Board, Azamgarh, to permit the petitioner to appear in Misc. Application No. 23 of 2019, arising out of Case Crime No. 24 of 2019 (State Vs. Roshan Khan @ Osama), under Sections- 147, 148, 307 I.P.C., Police Station- Kotwali, District- Azamgarh, and he may be released after taking personal bond of the petitioner and his natural guardian till declaration of juvenility of petitioner who was a student of 12th Class and he was appearing in the examination conducted by the Central Board of Secondary Examination of 12th Class in the year 2019.

DECISION OF THE COURT

Hon’ble Court held that juvenile Justice Board shall release the accused after taking personal bond, during the pendency of inquiry of the juvenility of accused.

Court further directed the Juvenile Justice Board, Azamgarh, to consider the law of this Court aforesaid and pass appropriate order on this application.
