Hon’ble Allahabad High Court allowed a petition while listening to the case of Smt. Sanju Sharma v. State Of U.P. And 3 Others here on 24-01-2019 stating that if there is no other legal impediment, case can be decided expeditiously fixing short dates.

BRIEF FACTS OF THE CASE

This Application was filed under Section 482 of the Code of Criminal Procedure, 1973 with a prayer that the lower court be directed to decide the Complaint Case No. 3154 of 2018, under Sections 498-A, 323, 506 IPC and Section 4 Dowry Prohibition Act, Police Station Kotwali, District Mau pending in the court of Chief Judicial Magistrate, Mau, expeditiously within a stipulated period.

Applicants argued that the lower court may be directed to decide the complaint as mentioned above expeditiously within a time frame as decided by this Court.

DECISION OF THE COURT

Hon’ble Court held that the court concerned is directed to decide the aforesaid case expeditiously fixing short dates in the matter if there is no other legal impediment.
