Allahabad HC: If execution proceedings are pending from long time the the matter is taken to its logical end expeditiously by fixing short dates

Hon’ble Allahabad High Court while dealing with the petition here on 27-02-2019 in the case of “Ganga Public Inter College v. Lakshmikant. And Another” stated that if execution proceedings are pending from long time it is desirable that the matter is taken to its logical end expeditiously by fixing short dates.

BRIEF FACTS OF THE CASE

This petition was filed for issuing a direction to the Executing Court to decide Execution Case No.21 of 2014 within a specified time frame.

In the supplementary affidavit it was stated that the execution proceedings are pending for execution of the decree for specific performance passed in Original Suit No.29 of 2009.

DECISION OF THE COURT

Hon’ble Court held that execution proceedings are pending since the year 2014, it is desirable that the matter is taken to its logical end expeditiously by fixing short dates provided there is no legal impediment.
