Hon’ble High Court while dealing with an appeal here on 18-01-2019 in the case of Atendra kumar & Others v. State of U.P stated that if the cause shown by the petitioner is sufficient the non bailable warrant can be recalled.

BRIEF FACTS OF THE CASE

A Non- Bailable Warrant was issued against the appellant vide order dated 03.12.2018 and as per the appellants they had no knowledge for hearing of the case and their previous counsel had also not informed to the appellant.

Thus, this appeal was made before hon’ble court to recall the Non- Bailable Warrant.

DECISION OF THE COURT

Hon’ble Court held that the cause shown by the petitioner is sufficient; therefore, the order dated 03.12.2018 by which the Non- Bailable Warrant has been issued against the appellants is recalled.

Court further directed the office to prepare the paper book within 30 days for final hearing.
