Hon’ble Allahabad High Court while dealing with the petition here on 15-02-2019 in the case of “Kanhaiyalal Sharma v. Principal Judge And Another” stated that effort should be made to conclude the proceedings as far as possible within six months in the matters of Hindu Marriage Act, 1955.
BRIEF FACTS OF THE CASE
The petition was filed for issuing a direction to the Principal Judge, Family Court, Mathura to decide petition under Section 9 of the Hindu Marriage Act, 1955 within a specified time.
DECISION OF THE COURT
Hon’ble Court held that the Section 21-B of the Hindu Marriage Act, 1955 specifically provides that all proceedings under the Act should be held on a day to day basis and effort should be made to conclude the proceedings as far as possible within six months from the date of service of the petition on the respondent.
