Hon’ble Allahabad High Court while dealing with the petition here on 06-02-2019 in the case of “Smt. Manorma Devi And Another v. Chhotey Lal Verma And 2 Others” stated that the disposal of Interim injunction application must be done within 6 months.

BRIEF FACTS OF THE CASE

This petition has been filed with a prayer to direct the Civil Judge (Junior Division), Varanasi to decide the Temporary Injunction Application (Paper No. 6-C) filed by the plaintiff-petitioners in Original Suit No. 1464 of 2018 in the original case of Manorama Devi and another vs. Chhotey Lal and others within a stipulated time frame.

DECISION OF THE COURT

Hon’ble HC held that all the subordinate courts must ensure to dispose of applications of interim injunction within six months, failing which they shall have to record reasons in the order sheet.
