Kirkland & Ellis is advising Franchise Group Inc., a first-class operator and acquirer of franchised and franchisable businesses on their chapter 11 cases pending in the U.S. Bankruptcy Court for the District of Delaware. Less than a week after Kirkland’s engagement, Kirkland proceeded with seeking approval of the Franchise Group’s proposed disclosure statement and related solicitation materials at a contested hearing where an ad hoc group of crossholder lenders sought to, among other things, adjourn the debtors’ disclosure statement hearing indefinitely. After arguments, the Bankruptcy Court overruled the motion to adjourn, approved Franchise Group’s Disclosure Statement and authorized the Franchise Group to commence solicitation on its proposed plan of reorganization.
