DLA Piper has advised Perth Airport on its landmark agreement with Qantas to facilitate AUD 5 billion of investment for the construction an additional runway, new domestic terminal, new international terminal, two new car parks and a hotel. Under the landmark agreement all Qantas and Jetstar operations will consolidate to one new state of the art terminal once complete.
“This is an important project for Western Australia and a significant milestone for Perth Airport and its investors,” said Perth-based Alyson Eather, International Co-Chair – Projects, DLA Piper.
“The agreement represents one of Australia’s most significant aviation infrastructure deals of recent times,” Alyson added.
The DLA Piper team included Alyson Eather (International Co-Chair – Projects), Simon Uthmeyer (Partner, Competition) and Richard Edwards (Partner, Litigation & Regulatory), who were assisted by Joe Malcom (Senior Associate, Competition), Sophia Grace (Special Counsel, Competition), Joely Wilkinson-Hayes, (Senior Associate, Competition), HeeJoo Kim (Graduate, Competition), Fionn Bowd (Consultant, Finance), Tara Ott (Solicitor, Finance), Tiarnne Morgan (Solicitor, Finance) and Maya Stampfer (Solicitor, Finance).
“The agreement reached between Perth Airport and Qantas demonstrates that the current light handed regulatory regime for aeronautical services at capital city airports works by delivering significant private investment in nationally significant airport infrastructure, without Government funding,” said Simon Uthmeyer, Partner, Competition.
“In the development of the commercial framework underpinning the economics of this deal we drew upon our broad experience in infrastructure regulation and our unique airport regulatory expertise. At all times we were focused on ensuring the framework satisfied shareholder objectives,” Simon added.
“This deal is hopefully the restart of major capital programs at capital city airports which were deferred due to the pandemic,” Simon added.
