Background of the case-
The petition was filed as the petitioner was issued only a Light Motor Vehicle License whereas he prays for Transport Vehicle License. The petitioner stated that he is already driving a light motor vehicle for the past thirteen years and thus should be granted a Transport Vehicle License rather than Light Motor Vehicle License.
Judgment-
The court stated that the Motor Vehicle Rules are not only for the benefit of persons who seek license but also for the public who are using the roads. The court said that a license of a vehicle to an illiterate person cannot be allowed as he is virtually a menace for the pedestrians as he is not in a position to understand road signs and caution notices on boards for human safety on the highways or any other roads in the city. The court said that the Transport Authorities have granted Light Motor Vehicle Licence to the petitioner though he is illiterate. The court ordered to withdraw the license of the petitioner and similar other persons who were allowed a license while being illiterate. The court also asked the State Transport Authorities to issue appropriate instructions regarding the guidelines and also take action on already issued License to persons who are unable to read and write.
