In January this year, Under Armour filed a civil suit for injunction and damages of Rs 2 crore before the Delhi High Court against Ludhiana based manufacturer Amit Apparels for sale of counterfeit products of its brand.
Earlier, an FIR was also registered in Ludhiana against Amit Apparels on 5th October, 2018 by Under Armour, Lacoste and Jordan under FIR No. 308 of 2018 and subsequently a criminal raid was conducted, which resulted in the seizure of huge counterfeit goods under the Trademark/Label Under Armour, Lacoste and Jordan from the defendant premises.
The Delhi High Court Bench having heard the counsels for Under Armour opined that it is a prima facie case of infringement and passing off is made out in favour of Under Armour and thus, to prevent the irreparable harm or injury, granted an interim injunction till the further orders, the defendants by itself/themselves as also through individual proprietors/partners, agents, representatives, distributors, assigns, heirs, successors, stockists and all other acting for and their behalf are restrained from soliciting, networking, intending to sell, manufacturing, marketing, using, selling, trading, soliciting, importing, exporting, displaying, advertising, purveying, intending to sell/solicit or on online websites or through social media or by any other mode or manner dealing in or using the impugned Trademark/Label Under Armour, or any other Word/Mark/Trade Mark/Label/Logo which may be identical with and/or deceptively similar to the plaintiff’s trademark/label/logo Under Armour.
The Delhi High Court in its order froze the manufacturing unit of the infringer directing it to maintain status quo on title, possession and construction thereof until further order.
