Hon’ble Allahabad High Court while dealing with the petition here on 26-02-2019 in the case of “Pradeep Kumar Agarwal And 2 Others v. Subhash Chand Malik” stated that it is the liberty given to the petitioners to challenge the impugned order of the trial Court along with final order.
BRIEF FACTS OF THE CASE
The petition was filed against an impugned order dated 12.11.2018 in which Judge, Small Causes has rejected the application 266 Ga filed by the petitioners, who are plaintiffs in SCC Suit No. 15/1999 declining to take on record photo copy of notice dated 17.6.1998. Also, the Revisional Court dismissed the revision in limine on the ground that revision against an interlocutory order is not maintainable.
Further counsel for the petitioners, after some argument, reserved his right to challenge the impugned order along with final order passed in the suit.
DECISION OF THE COURT
Hon’ble Court held that it is the liberty given to the petitioners to challenge the impugned order of the trial Court along with final order.
Thus, the instant petition was disposed.
