Hon’ble Allahabad High Court while dealing with the petition here on 25-02-2019 in the case of “Digambar Singh v. Smt. Saroj Devi” stated that interlocutory order could be challenged along with final order passed in proceedings, when appeal is filed.
BRIEF FACTS OF THE CASE
This petition was filed against an impugned order dated 15.1.2019 by which the Prescribed Authority has declined to inspect the premises in dispute in proceeding under Section 21(1)(a) of U.P. Act No. 13 of 1972.
DECISION OF THE COURT
Hon’ble Court held that the impugned order is an interlocutory order and could be challenged along with final order passed in proceedings, when appeal is filed.
It further stated that, this Court is not inclined to examine the validity of the impugned order at this stage, but disposes of the petition with liberty to the petitioner to challenge the same along with final order.
