Dengue death case: FIR against Fortis

A First Information Report has been registered against Fortis Memorial Research Institute, Gurugram on charges of culpable homicide not amounting to murder in connection with the death of a seven-year-old during dengue treatment earlier this year.

Giving details about the FIR, Haryana Health Minister Anil Vij tweeted on Sunday morning: “FIR No. 639 Registered against #FortisHospital Gurugram at Sushant Lok Gurugram Police Station u/s 304 Part 2 by Health Department Haryana (sic).” Sushant Lok Police Station, Station House Officer, Inspector Gaurav Phogat said that the FIR was registered late on Saturday night and doctor Vikas Verma had been named in it.

The victim’s father Jayant Singh had also made a formal complaint to the Gurugram Police on December 8 seeking registration of a FIR against the hospital management under various criminal charges. Mr. Singh, a resident of Sector 12, Dwarka, had accused the FMRI management, treating doctors and staff of culpable homicide of his daughter in his 11-page complaint. He had also pressed charges of destruction of evidence, forgery and criminal conspiracy against the management, the treating doctors and the staff.

Mr. Singh, in his complaint, has accused Dr. Vikas of allegedly removing the ventilator pipes and ambu-bag attached to his daughter causing her death. He said that his daughter struggled to breathe and died in the ambulance within a matter of minutes after removal of life sustaining equipment.

Mr. Phogat said that the complaint given by Mr. Singh will be merged with the FIR registered at the behest of the Haryana Health Department.

The Health department had on Saturday also written to the Haryana Urban Development Authority to cancel the lease of land to Fortis hospital in Gurugram due to alleged violations of terms and conditions of agreement.
