The replies in the National Herald Case, by Sonia and Rahul Gandhi are set to be filed today to BJP leader Subramanian Swamy’s plea, seeking documents from the Associated Journal Limited.
The case was filed on the grounds that the party members had illegally granted an interest free loan to the Associated Press Journal Limited of Rs 90.25 crores. It was alleged that the loan was not repaid.
The Delhi Court on July 1, 2017 sought a reply from both the members, in the present case. In his application, Swamy sought documents from the publishing company including the copy of the ledger extract, bank statement filed with Registrar of Companies (ROC), minutes of the meeting in which the decision to convert the loan into share capital was taken, balance sheet, profit and loss account with auditors report in the year in which the loan was taken.
These documents, sought also asked the Congress party to submit their minutes of meeting, the copy of the ledger extracts of AGL accounts in book of the Congress party and the copy of the loan agreement between congress and the Publishing House.
Mr. Swamy had submitted that these documents were requisite for conducting a fair trial and hence should be filed in Court.
The Court, in the previous hearings had granted bail to Sonia, Rahul, Vora, Fernandes and Dubey, who had appeared before it under the charges of Dishonest Misappropriation of Property, Criminal Breach of Trust, Cheating and Criminal Conspiracy under the Indian Penal Code, 1860.
While the Gandhis and the other accused have denied the allegations levelled against them, they have been asked to submit the required documents along with their replies, by today.
Further hearing will take place today on July 22, 2017.
