10 Questions You Need to Ask Before Hiring an Injury Lawyer

By Legal Desire 8 Min Read

Dealing with injuries and assault is not an easy endeavor as it is usually accompanied by emotional, physical, and psychological trauma. If the injury is a result of another person’s negligence or breach of duty, you can get in touch with an assault attorney to help you get the best compensation out of the scenario. You need to do this especially because most accident victims can’t think clearly about the next logical step after suffering some degree of trauma. Also, these experts know the nook and cranny of assault cases and can help you gather witnesses, evidence, and statements.

Usually, getting an assault lawyer to represent you in an informal settlement setting or court trial can be a daunting task. This is because most general practitioners do not have the required expertise to handle the intricacies of cases like this. They can only help you in limited circumstances. You need someone like Lamber Goodnow that is armed with adequate experience and skill to handle a wide variety of assault cases.

Do not try to file the claim yourself as you might be undercharging or underestimating the extent of the damage. As such, we intend to go through some important questions that you need to ask before hiring one of these experts. This is important because, over the trial period, you will have to get very close to your attorney personally. Hence, they should be someone that you’ve done some research on. They should also be someone you can trust and confide in. We recommend that you meet a minimum of two experts and ask them questions before concluding.

Ask About The Fees And Payment Policy

As a start, ask about their charge and payment policy. If you’re lucky, you might meet an attorney that is ready to help you for free. Typically, most of these experts wait till the case is successful before getting paid. It means that they don’t get paid if you do not get compensated at the end of the day. This method is good for both parties as it ensures that the expert does their best to come out on top. As soon as the case becomes successful, the expert will take a percentage of the settlement as payment for the legal services rendered.

Who Will Handle The Expenses If The Trial Doesn’t Go In Your Favor?

This is the second question you should ask as settling payment issues precedes lots of things in these case types. Usually, the expert has to spend some of his money to do some things related to the case. It includes gathering evidence, visiting and getting witnesses, hiring forensic or medical experts, and so on. These expenses are different from the case charge itself. It would be easy to pay if you win the case but the same can’t be assumed if you lose. Hence, you should iron this out before hiring.

Ask If The Attorney Has Experience With A Similar Case

This is very important as assault lawyers usually have different expertise. Some are experts in handling automobile accidents while others only handle animal bite cases. Do not assume that all assault lawyers have experience with all case types. Hiring someone that has no experience with your case peculiarities might lead to unfavorable outcomes. Hence, you should know their area of expertise before hiring.

Ask How Much Devotion In Terms Of Time Can They Put In The Case

Injury cases always come up almost every day. So, these experts are usually saturated with too many caseloads and won’t hesitate to add more to their plates. Hence, you should ask how devoted they will be to the case to ensure that it is successful.

What Is The Expected Duration Of The Whole Process?

This is another crucial question that you must ask. The typical duration depends on the case type, the complexity, how easy it is to gather evidence, and the number of witnesses to question. A good attorney should be able to give you an average expected duration.

Will I Get A Settlement Or Proceed To Trial?

Usually, there are two ways of approaching an injury case. The first one is to try an amicable settlement between both parties. If this doesn’t work, the case will proceed to trial. Your attorney must be prepared for the worse and must be able to answer if your case is likely to proceed to trial. This will ensure that they make all necessary preparations and gather all crucial documents and evidence.

Ask The Lawyer How Much You Should Expect From The Case

Usually, the expert should make a comprehensive assessment of all damages incurred from the accident. They should consult other medical experts to get a good look at how much treatment will cost in the long run. Hence, get a good estimate of the case’s worth from them and be careful of people that promise you outrageous settlements.

Ask Who Will Be In Charge Of Your Case

Usually, some firms will present a senior colleague at the hiring stage and transfer your case to less experienced lawyers as the case proceeds. Regardless of what you do, we suggest you view this website and, at least, have a better understanding of your case. This is a common tactic that you should get ahead of at the hiring stage. Ask who you should contact in case of any new development in your case and if they are junior colleagues, ask for their supervisor’s contact.

Ask What Is Expected Of You During The Whole Process.

If you’re the type that likes to be involved in every detail of the case, lay it down at the hiring stage and let them assure you if they agree with you. If you do not want to be involved heavily, ask for the things you will be expected to provide as the case proceeds.

Ask If You Can Get In Touch With Former Clients.

This is very crucial as it is not tactical enough to rely on reviews posted on websites and ads. Get the contacts of the attorney’s past client and ask them for an honest review.
